# Festival Auction Terms and Conditions
By registering for an account, placing a bid, or otherwise participating in the Festival Auction conducted for Notre Dame Catholic School in Kerrville, Texas, you acknowledge that you have read, understand, and agree to the following Terms and Conditions.
## 1. Bidder Registration
Bidders must provide accurate and current information when registering for the auction. This may include the bidder's name, email address, telephone number, username, and other information reasonably necessary to administer the auction.
Bidders are responsible for maintaining the security of their account and for all bids placed through their account.
## 2. Bids
All bids placed through the Festival Auction website are considered genuine offers to purchase the applicable auction item.
Once submitted, a bid may not be withdrawn or canceled except at the discretion of the auction administrator.
At the close of an auction, the highest valid bid recorded by the auction system will generally be considered the winning bid.
Notre Dame Catholic School and the auction administrators reserve the right to correct errors, resolve bidding disputes, remove invalid bids, withdraw an item from the auction, or cancel or modify an auction when reasonably necessary.
## 3. Winning Bidders
Winning bidders will be notified using the contact information provided during registration.
The winning bidder is responsible for making arrangements with the Notre Dame Catholic School office for payment and pickup of the item.
Payment and pickup arrangements must be made within **15 calendar days of the close of the auction and notification of the winning bidder**.
Failure to make satisfactory payment and pickup arrangements within this period may result in forfeiture of the winning bid. In that event, Notre Dame Catholic School may offer the item to another bidder, return the item to the donor, or otherwise dispose of the item at its discretion.
## 4. Payment
Payments are **not processed through the Festival Auction website** unless specifically stated otherwise.
Winning bidders will arrange payment directly through the **Notre Dame Catholic School office**. Instructions regarding acceptable payment methods and other payment arrangements will be provided to winning bidders.
An auction item will not be considered fully purchased until the required payment has been received or satisfactory payment arrangements have been approved by Notre Dame Catholic School.
## 5. Item Pickup
Winning bidders are responsible for arranging and completing pickup of their auction items.
Unless otherwise specifically stated in an item's description, shipping and delivery are not included.
The winning bidder is responsible for any transportation, loading, packing, or other arrangements necessary to remove the item.
## 6. Auction Items
Auction items may have been donated by individuals, businesses, organizations, or other supporters.
Unless specifically stated otherwise, all items are offered **“as is” and “where is.”** Descriptions, photographs, estimated values, dimensions, condition information, and other information are provided for convenience and are believed to be reasonably accurate, but they are not guarantees or warranties.
Bidders are responsible for reviewing the description and available information before placing a bid.
Notre Dame Catholic School, its volunteers, auction administrators, and donors make no warranties, express or implied, regarding the condition, merchantability, fitness for a particular purpose, authenticity, or value of an auction item except where specifically stated.
## 7. Gift Certificates, Services, and Experiences
Items involving gift certificates, services, reservations, tickets, experiences, or similar benefits may be subject to expiration dates, scheduling requirements, availability, restrictions, or other conditions established by the donor or provider.
The winning bidder is responsible for reviewing and complying with those conditions.
## 8. Website Availability and Technical Issues
Reasonable efforts will be made to keep the Festival Auction website available and to accurately record bids.
However, uninterrupted operation of the website cannot be guaranteed. Internet outages, device problems, server interruptions, software errors, or other technical problems may occur.
If a technical problem affects an auction or the accuracy of bidding, the auction administrators may take reasonable action to resolve the issue, including extending, reopening, correcting, or canceling an auction when appropriate.
## 9. Privacy and Use of Personal Information
Information collected through the Festival Auction website is collected **solely for purposes related to administering this auction**, including bidder registration, identifying winning bidders, contacting participants, coordinating payment and pickup, maintaining auction records, and communicating information related to the auction.
Personal information collected through the website **will not be sold, rented, or provided to outside parties for unrelated marketing or commercial purposes**.
Information may be accessed by Notre Dame Catholic School personnel, authorized volunteers, or service providers when reasonably necessary to operate and administer the auction.
Information may also be disclosed when required by law or when reasonably necessary to protect the security or integrity of the auction and its participants.
## 10. Email and Text Communications
By providing an email address, bidders consent to receive communications reasonably necessary to administer the auction.
If a bidder elects to receive text message notifications, the bidder consents to receiving auction-related SMS messages at the telephone number provided. Standard message and data rates may apply.
Auction-related communications may include bid notifications, auction closing notices, winning bidder notifications, and information concerning payment or item pickup.
## 11. Eligibility and Conduct
Participants must be legally able to enter into a binding transaction.
Bidders may not manipulate the auction, interfere with the website, submit fraudulent information, artificially increase bidding, access another bidder's account, or otherwise engage in activity intended to compromise the fairness or operation of the auction.
Accounts or bids associated with suspected fraudulent or abusive activity may be suspended or removed.
## 12. Limitation of Responsibility
To the extent permitted by law, Notre Dame Catholic School, its clergy, employees, volunteers, auction administrators, and participating donors will not be responsible for losses resulting from technical problems, inaccurate information supplied by third parties, failure of communications, bidder error, or the condition or use of an auction item.
Nothing in these Terms and Conditions is intended to waive any rights or protections that cannot legally be waived.
## 13. Changes to These Terms
Notre Dame Catholic School may update these Terms and Conditions when reasonably necessary. The version posted on the Festival Auction website at the time a bidder participates in an auction will govern that participation.
## 14. Acceptance of Terms
By creating an account or placing a bid, you confirm that you have read, understand, and agree to these Terms and Conditions.
